1. Scope and Agreement
This Acceptable Use Policy ("AUP") applies to all users of NiishCloud services, including hosting, domain registration, business email, managed infrastructure, and multi-tenant software applications (such as AVA Closer, Sentinel, and related business suites). By using any NiishCloud service, you agree to comply with this AUP in addition to our Terms of Service and Privacy Policy.
2. Prohibited Email and Messaging Conduct
NiishCloud maintains a zero-tolerance policy toward abusive email and messaging practices. You must not use NiishCloud infrastructure to send, facilitate, or distribute:
- Unsolicited bulk email (SPAM) or cold outreach to recipients who have not provided explicit, verifiable consent
- Messages to purchased, rented, scraped, or harvested email lists, including lists obtained from third-party data brokers or public web scraping
- Phishing, impersonation, or deceptive sender identity designed to mislead recipients about the origin or purpose of a message
- Email containing malware, ransomware, spyware, or links intended to compromise recipient systems
- Messages that circumvent bounce or complaint suppression lists, including re-sending to addresses that have hard-bounced or filed abuse complaints
- High-volume marketing sends without documented opt-in or double opt-in consent from each recipient
3. Permitted Email Use
Permitted uses of NiishCloud email and messaging infrastructure include:
- Transactional email — account verification, password resets, hosting provision alerts, invoice notifications, and server monitoring alerts
- Opt-in subscriber communications — newsletters, appointment reminders, and customer support updates sent only to recipients who have explicitly subscribed and may unsubscribe at any time
- Verified business correspondence — messages to existing customers and prospects who have initiated contact or completed a documented consent workflow
All marketing and bulk communications must include a clear unsubscribe mechanism and honor opt-out requests promptly.
4. Tenant and Customer Responsibilities
If you operate a business application on NiishCloud that sends email on behalf of your end-users, you are responsible for:
- Enforcing opt-in or double opt-in consent before any marketing send
- Maintaining accurate suppression lists for bounces, complaints, and unsubscribes
- Configuring SPF, DKIM, and DMARC authentication for domains you control (see our Email Authentication Guide)
- Ensuring your end-users comply with this AUP and applicable anti-spam laws (CAN-SPAM, GDPR, CASL, and similar regulations)
5. General Prohibited Uses
In addition to email restrictions, you must not:
- Upload, host, or transmit content you do not own or lack legal rights to use
- Use services to distribute harmful code or interfere with network integrity
- Engage in fraudulent, abusive, or unlawful activity on NiishCloud infrastructure
- Attempt to probe, scan, or test vulnerabilities without authorization
- Resell or sublicense services in violation of your agreement
6. Monitoring, Enforcement, and Abuse Reports
NiishCloud monitors network activity and email reputation metrics to protect our infrastructure and recipients. We may investigate suspected violations and take action including:
- Warning the account holder and requiring corrective action
- Temporarily suspending email or hosting capabilities pending review
- Permanently terminating accounts that violate this AUP or pose ongoing risk
- Cooperating with law enforcement and upstream providers as required by law
Accounts exceeding a 2% hard bounce rate or a 0.05% complaint rate may be automatically flagged and have sending capabilities paused pending manual review.
Third parties may report abuse at abuse@niishcloud.com. We review abuse reports within 24 business hours.
